Las modificaciones del Código Civil en materia de nacionalidad previstas en el proyecto de ley de Adopción Internacional aprobado por el Gobierno el pasado 15 junio, no entrarán en vigor hasta un año después de su publicación en el Boletín Oficial del Estado (BOE). Está previsto que las Cortes aprueben la ley en noviembre de 2007, con lo cual hasta noviembre de 2008 no entrarán en vigor. Además, los nietos que se quieran acoger a la nueva regulación sólo dispondrán de un plazo de dos años para hacerlo.

Modificaciones al Código Civil:

Las modificaciones del Código Civil en materia de nacionalidad aprobadas por el Gobierno aparecen recogidas en los apartados dos, tres y cuatro de la Disposición Final Primera

El apartado dos recoge la modificación de la letra b) del artículo 20.1 del Código Civil y que quedaría redactado de la siguiente manera: “b) Los descendientes de español o española, siempre que su padre o madre hayan sido españoles de origen, con independencia del lugar y de la fecha de nacimiento de cualquiera de ellos”.

El apartado tres añade un nuevo artículo 20 bis al Código Civil que diría los siguiente: “Los hijos de española de origen nacidos antes de la entrada en vigor de la Constitución de 1978 que hubieran seguido la nacionalidad extranjera del padre, podrán optar por la nacionalidad española de origen cumpliendo con las condiciones previstas en los artículos 21.3 y 23 de este Código”.

Por último, en el apartado cuatro de esta Disposición Final Primera se señala que la letra f) del artículo 22.2 del Código Civil quedaría redactado de la siguiente manera: “f) El nacido fuera de España que sea descendiente de abuelo o abuela originariamente españoles”.

Con estas modificaciones se elimina la exigencia de que los padres del optante a la nacionalidad tuvieran que ser nacidos en España. Este cambio facilita el acceso a la nacionalidad a los nietos de españoles. Además, con estos cambios también se elimina la discriminación respecto a las mujeres nacidas antes de la aprobación de la Constitución, que no podían transmitir la nacionalidad a sus descendientes.

Lo que no está claro es que pasa con los nietos que su padre o madre fallecieron sin poder recuperar la nacionalidad (por parte de abuelo).
